There should be no consideration of the state of the game at all.
It is equally unfair to wait for a player to shoot - unfair on the defense. if it is time it is time and you should blow time.
Referees should completely ignore the penalty area for fouls.
If it is a foul you signl the infraction. If it is in the openalty area THEN a penalty kick results. It should in no way enter into the judgement oif oul or no foul.
